Terms of Use (EULA)

These Terms of Use ("Terms") are a binding agreement between you and ERKOMOBİLE TEKNOLOJİ ANONİM ŞİRKETİ ("Erkomobile", "we", "us") regarding your use of the PDF Scanner mobile application and the website at pdf.erkomobile.com (the "Service").

By downloading, installing or using PDF Scanner, you agree to these Terms. If you do not agree, do not use the Service. These Terms are between you and Erkomobile only — not with Apple Inc.

2. Licence

Subject to your compliance with these Terms, Erkomobile grants you a limited, non-exclusive, non-transferable, revocable licence to download and use PDF Scanner on Apple-branded devices that you own or control, in accordance with the Usage Rules set out in the Apple Media Services Terms and Conditions. This licence is the standard Licensed Application End User Licence Agreement (EULA) between you and Erkomobile. You may not sell, rent, sublicense, redistribute or reverse-engineer the Service except where such restriction is prohibited by applicable law.

3. Subscriptions, free trials and billing

PDF Scanner is free to download. PDF Scanner Premium is offered as an auto-renewing subscription, processed by Apple and charged to your Apple ID. The current plans are:

Prices in your local currency are shown at the point of purchase and may vary by region and applicable tax.

• Payment is charged to your Apple ID on confirmation of purchase.
• Subscriptions renew automatically at the same price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription in your Apple ID settings: Settings → [your name] → Subscriptions.
• Where a plan includes a free trial, the trial begins when the subscription is started. If you cancel during the trial you will not be charged; if you do not cancel, the trial converts automatically into a paid subscription at the price above.
• Any unused portion of a free trial is forfeited if you purchase a subscription during the trial period.
• If you cancel after the trial, access continues until the end of the paid period.
• All purchases are final as far as Erkomobile is concerned; refunds are requested from Apple at reportaproblem.apple.com. See section 4.

4. Refunds

Refunds. All purchases are processed by Apple, and refund decisions are made solely by Apple in accordance with its policies. By making a purchase and subsequently requesting a refund through Apple, you acknowledge and agree that we may provide Apple with information about your purchase and app usage activity, as described in our Privacy Policy, to assist Apple in evaluating your refund request.

5. Your content

You retain all rights to the documents you create with the Service. Erkomobile claims no ownership over them and, as described in the Privacy Policy, does not receive them. The Service contains no upload, community or sharing feature operated by us.

6. Acceptable use

You are responsible for the documents you scan and for having the right to scan them. You agree not to use the Service to:

• forge, alter or falsify documents with intent to deceive;
• reproduce identity documents, currency or securities where doing so is unlawful in your jurisdiction;
• process documents you have no legal right to copy or possess;
• reverse engineer, decompile or disassemble the app, except as permitted by law;
• bypass technical limitations or security features, or use the Service to develop a competing product;
• violate any applicable law, regulation or third-party right.

7. Electronic signatures

The signature feature places an image of a signature onto a PDF. Whether such a signature is legally binding depends on the law of your jurisdiction and the requirements of the receiving party. Erkomobile makes no representation that a signature created with the Service satisfies any particular legal or evidentiary standard, and it is not a qualified electronic signature under eIDAS or equivalent regimes.

8. Text recognition accuracy

Optical character recognition is probabilistic and its accuracy depends on image quality, typeface, language and lighting. Erkomobile does not warrant that recognised text will be accurate or complete. Do not rely on OCR output alone for legal, medical, financial or safety-critical purposes without verifying it against the original document.

9. Intellectual property

The Service, including all software, designs, icons, trademarks and documentation, is owned by Erkomobile or its licensors and is protected by intellectual property law. Except for the limited licence granted in section 2, no rights are transferred to you.

10. Data loss and backup

You are responsible for maintaining backups of your documents. Erkomobile is not liable for the loss of documents caused by device failure, device loss or theft, deletion of the app, iOS updates, iCloud account changes or user error. We strongly recommend enabling iCloud backup and periodically exporting important documents to a second location.

11. Disclaimer of warranties

The Service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Erkomobile does not warrant that scanning will succeed on every document, that the Service will be uninterrupted or error-free, or that defects will be corrected. Nothing in this section limits rights you have under mandatory consumer protection law in your country of residence.

12. Limitation of liability

To the maximum extent permitted by law, Erkomobile and its officers, directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service shall not exceed the greater of the amount you paid to Erkomobile in the twelve months preceding the claim, or fifty US dollars (USD 50).

13. Apple-specific terms

You acknowledge and agree that:

• these Terms are between you and Erkomobile only, not with Apple, and Erkomobile alone is responsible for the Service and its content;
• Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Service;
• in the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the Service;
• Apple is not responsible for addressing any claims by you or any third party relating to the Service, including product liability, failure to conform to any legal or regulatory requirement, and consumer protection claims;
• Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that the Service infringes intellectual property rights;
• you represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

14. Termination

This licence remains in effect until terminated. It terminates automatically if you fail to comply with these Terms, and you may terminate it at any time by deleting the app from your devices. Sections 5 and 9 through 16 survive termination.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above and, where they affect your rights, noted in the app's release notes. Continued use after an update constitutes acceptance of the revised Terms.

16. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The courts and enforcement offices of İstanbul (Anadolu) shall have jurisdiction, save where mandatory consumer law grants you the right to bring proceedings in the courts of your place of residence.
